  1. Act of Sexual Abuse
    A person must commit sexual abuse against another individual.

  2. Definition of Sexual Abuse
    Sexual abuse occurs when a person, with the intent to sexually molest, arouse, or gratify, does any of the following:

    • Touches the victim’s genitalia, anus, groin, breast, or buttocks—or the clothing directly covering those intimate parts.

    • Forces the victim to touch the offender’s, another person’s, or the victim’s own intimate parts.

    • If the victim is under 13, causes or assists the child to touch the offender’s, their own, or another person’s intimate parts.

    • Forces another person to touch the victim’s intimate parts.

  3. Against the Victim’s Will
    The act must occur without the victim’s consent.

  4. Use of Coercion
    The offense must be carried out through force, threat, intimidation, or deception.
